MagikFlame does not receive your specific loan terms, APR, interest rate, or payment schedule. Text / SMS Messages: We do not use SMS or text messages for marketing communications. We may use SMS, email, or phone to communicate with you regarding technical support, order updates, or delivery coordination. These are transactional communications related to your purchase or support request and are not marketing messages. If this practice changes in the future, we will update this Policy and obtain your consent before sending any marketing text messages.

Your Rights Regarding Your Information

Depending on where you live, you may have rights over your Personal Information, such as the ability to access, correct, delete, or limit how we use it, or to request a copy of your Personal Information.

We will respond to your requests within the time required by applicable law. For more information on how to exercise any applicable rights you may have under California Privacy Laws, please contact us at privacy@magikflame.com. Please note that we may require you to verify your credentials, by matching your e-mail address, or other information to the information in our systems, before you can submit a request to exercise any of these rights. Residents of Other U.S. States

If you reside in a U.S. state with a comprehensive consumer privacy law (including but not limited to Colorado, Connecticut, Virginia, Oregon, Delaware, Montana, Iowa, Tennessee, Indiana, Texas, New Jersey, Maryland, Minnesota, Nebraska, New Hampshire, and Kentucky), you may have additional rights regarding your Personal Information, including:

International Jurisdictions

Our Services are hosted and offered in the United States of America (US), and are subject to US federal, state, and local law. If you are accessing the Services from another country, please be advised that you may be transferring your personal information to us in the US, and you consent to that transfer, processing and storage of your personal information in accordance with this Privacy Notice. You also agree to abide by the applicable laws of applicable US federal, state, and local laws concerning your use of the Services and your agreements with us. Any persons accessing our Services from any jurisdiction with laws or regulations governing the use of the Internet, including the collection, use, or disclosure of personal information, different from those of the jurisdictions mentioned above may only use the Services in a manner lawful in their jurisdiction. If your use of the Services would be unlawful in your jurisdiction, you may not use our Services.

Security

We use physical, technical and organizational measures designed to protect your information against unauthorized access, theft and loss. We restrict access to your personal information to those employees who need to know that information to service your account or perform their job functions. To guard your information delivered to us electronically, our web sites use Secure Sockets Layer (SSL). SSL encrypts your credit card number, name and address so only we are able to decode your information

Although we take precautions intended to help protect information that we process, no system or electronic data transmission is completely secure. Any transmission of your personal data is at your own risk and we expect that you will use appropriate security measures to protect your personal information.

You are responsible for maintaining the security of your account and the information in your account. We may suspend your use of all or part of the Services without notice if we suspect or detect any breach of security. You understand and agree that we may deliver electronic notifications about breaches of security to the email address on record on your account.

Data Retention

Unless you request that we delete certain information (see Your Rights and Choices Regarding Your Information), we retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy. Because MagikFlame products carry a limited warranty and may require ongoing technical support, we retain customer records — including your name, contact information, order history, and transaction details — indefinitely so that we can verify your purchase, provide technical support, honor warranty claims, and maintain accurate business records. We do not sell customer records. This information is kept strictly confidential and used only for the purposes described in this Policy.

The criteria used to determine our retention periods include:

The length of time we have an ongoing relationship with you and provide services to you. Because our products may require technical support at any point during their lifespan, we consider the customer relationship to be ongoing indefinitely after purchase;

Whether there is a legal obligation to which we are subject (for example, tax and accounting laws require us to retain transaction records, and product safety regulations may require us to maintain customer contact information for recall notifications);

Whether retention is advisable considering our legal position (such as for statutes of limitations, litigation, regulatory investigations, or product liability claims).

Certain Personal Information is transmitted directly to third-party partners at the time you interact with our website (for example, when you complete a purchase or submit a form). We do not store this information on behalf of those third parties. If you submit a request to delete your Personal Information under applicable privacy law, we will honor that request to the extent required by law. However, we may retain certain information that is necessary for us to: (a) complete a transaction or provide a service you requested; (b) verify your identity for future technical support or warranty claims; (c) detect and prevent fraud; (d) comply with legal obligations, including tax and accounting requirements; or (e) exercise or defend legal claims. We will inform you if we are unable to fully comply with a deletion request and explain the basis for retaining any information.

Artificial Intelligence and Automated Tools

MagikFlame may use artificial intelligence (“AI”) and automated tools to assist with certain aspects of our Services, including but not limited to: customer support chatbots, automated email responses, support ticket processing, and chat widget interactions. When you interact with an AI-powered tool on our Website or through our customer support channels, we will clearly disclose that you are communicating with an AI system, not a human representative. You may request to speak with a human representative at any time during an AI-assisted interaction.

Information you provide during AI-assisted interactions — including the content of your messages, questions, and any Personal Information you share — may be processed by third-party AI service providers on our behalf. These providers are contractually obligated to process your information solely for the purpose of providing the AI-powered service and are prohibited from using your information for their own purposes, including training their AI models on your data, unless separately disclosed and consented to. We do not use AI to make automated decisions that produce legal or similarly significant effects concerning you without human review.

Under California law (Cal. Civ. Code ?17941, the California Bolstering Online Transparency Act), businesses are required to disclose when a person is communicating with an AI bot rather than a natural person. We comply with this requirement and applicable similar laws in other jurisdictions. For questions about our use of AI tools, please contact us at privacy@magikflame.com.

Links to Other Sites

Our Website may include links to third-party websites and services that are not operated by us. When you click these links, you will be directed away from our Services. A link to a third-party website or service does not mean that we endorse it or the quality or accuracy of information presented on it. If you decide to visit a third-party website or service, you are subject to its privacy practices and policies, not ours. This Privacy Policy does not apply to any personal information that you provide to these other websites and services.

Changes to This Policy

MagikFlame may update this Privacy Policy at any time and any changes will be effective upon posting. In the event that there are material changes to the way we treat your Personal Information, we will update the Last Modified date at the top of this Policy upon becoming effective. We may also notify you by email, in our discretion.
